The WELLNESS CARD: Terms and Conditions.

1. THESE TERMS AND CONDITIONS (“TERMS”) GOVERN THE USE OF THE WELLNESS WAREHOUSE CARD (“WELLNESS CARD”), PARTICIPATION IN THE WELLNESS WAREHOUSE REWARD SCHEME (“REWARD SCHEME), THE COLLECTION AND USE OF THE REWARD SCHEME REWARDS (“REWARD GIFTS”) AND ANY OFFERS ASSOCIATED WITH THE REWARD SCHEME. IN THESE TERMS ANY REFERENCE TO “WELLNESS” IS A REFERENCE TO WELLNESS WAREHOUSE (PTY) LTD.

2. THESE TERMS SET OUT THE TERMS OF THE AGREEMENT BETWEEN WELLNESS WAREHOUSE (PTY) LTD AND HOLDERS OF THE WELLNESS CARD (INCLUDING ANY ADDITIONAL CARDHOLDERS APPOINTED PURSUANT TO PARAGRAPH 16 OF THESE TERMS) (THE REWARD SCHEME “MEMBERS”).

3. THE REWARD SCHEME IS OPEN TO ALL SOUTH AFRICAN AND INTERNATIONAL CUSTOMERS. WELLNESS RESERVES THE RIGHT TO DECLINE TO ISSUE A WELLNESS CARD FOR ANY GOOD REASON THEY SEE FIT.

4. SUBJECT TO PARAGRAPHS 5 AND 10 OF THESE TERMS, REWARD SALES CAN BE EARNED AT ANY WELLNESS STORE AND MAY BE REDEEMED FOR REWARD GIFTS WHEN REACHING THE SALES BALANCE TIERS SPECIFIED IN PARAGRAPH 8 OF THESE TERMS AT WELLNESS WAREHOUSE STORES, EXCLUDING WELLNESS SELECT STORES. PLEASE REFER TO OUR WEBSITE (WWW.WELLNESSWAREHOUSE.COM) OR CONTACT CUSTOMER SERVICES ON 0860 LIVE LIFE WELL FOR UP TO DATE DETAILS ON EXCLUDED STORES.

5. REWARD TOTALS CANNOT BE EARNED AND REWARD GIFTS CANNOT BE REDEEMED WHERE THE FOLLOWING TYPES OF TRANSACTIONS ARE CONDUCTED: (A) DELIVERY CHARGES; (B) PURCHASES OF WELLNESS PRODUCTS FROM ANY STORE WHICH IS NOT A WELLNESS FREE-STANDING STORE; (C) THE PURCHASE OF GIFT CARDS (WHEN USING THE GIFT CARD AS A PAYMENT TYPE A CUSTOMER WILL EARN REWARD SALES IF THEY ARE A REWARD SCHEME MEMBER). (D) PHARMACY SCRIPTS. (E) PROMOTIONAL ITEMS. (F) NET ITEMS WELLNESS RESERVES THE RIGHT TO CHANGE THESE EXCLUSIONS FROM TIME TO TIME.

6. REWARD GIFTS MAY ONLY BE REDEEMED BY THE PRIMARY MEMBER. ONCE A GIFT HAS BEEN REDEEMED; THAT MEMBER WILL NOT BE ELIGIBLE TO EARN FURTHER REWARD GIFTS IN THE SAME TIER UNTILL THE NEXT REWARD PERIOD.

7. REWARD GIFTS WILL BE AWARDED ON THE BASIS SPECIFIED IN PARAGRAPH 8 OF THESE TERMS. THE REWARD GIFTS WILL BE CALCULATED ON THE BASIS OF QUALIFYING PURCHASES EXCLUDING VAT MADE BY MEMBERS DURING A SPECIFIC PERIOD (“THE REWARD PERIOD”). Accumulated REWARD SALES during any REWARD PERIOD MAY be redeemed for the selected GIFTS WHEN MEMBERS reach the required REWARD SALES / Rand value spent FOR EACH TIER.

The SALES TOTALS will only be valid for the REWARD PERIOD starting on the 1st Feb 2010 EXPIRING ON THE 31ST DECEMBER 2010, for the fiRst REWARD PERIOD, and there forth, the REWARD PERIOD will be from the 1st of JANUARY 20XX EXPIRING ON the 31ST of DECEMBER 20XX+1.

8. DURING EACH REWARD PERIOD, THE AMOUNT OF ANY QUALIFYING PURCHASES WILL BE ADDED TOGETHER TO FORM MEMBERS SALES REWARD TOTAL (“SALES BALANCE”). THE TABLE BELOW INDICATES THE BASIS ON WHICH REWARDS PRIZES WILL BE ISSUED AGAINST THE RELEVANT LEVEL OF SALES BALANCE.

If the prizes specified by the various adverts are not available at the time of redemption, a replacement prize of the same value and function will be selected.

9. A PORTION OF MEMBERS REWARD BALANCE MAY NOT BE REWARDED (“THE UNREWARDED SPEND”) WHERE THE AMOUNT OF MEMBERS REWARD BALANCE FALLS BETWEEN THE THRESHOLDS FOR REWARD GIFTS. THE UNREWARDED SPEND WILL NOT BE CARRIED FORWARD TO COMPRISE PART OF MEMBERS REWARD BALANCE THROUGHOUT THE COURSE OF THE FOLLOWING REWARD PERIOD.

10. IN ORDER FOR A PURCHASE TO QUALIFY AS A QUALIFYING PURCHASE, THE WELLNESS CARD MUST BE PRESENTED AT THE TIME OF PURCHASE OR (WHERE A PURCHASE IS MADE ONLINE OR BY TELEPHONE ORDER THE WELLNESS CARD NUMBER MUST BE PROVIDED.

 

 

11. THE MEMBERS WELLNESS CARD AND POSITIVE IDENTIFICATION MUST BE PRESENTED AT THE TIME OF REDEMPTION OF ANY REWARD GIFT. REWARD GIFTS MAY ONLY BE REDEEMED BY THE PERSON NAMED ON THE WELLNESS CARD.

12. A fee of R30 will be charged for the replacement of a lost or damaged card. This fee may change from time to time as cards become more/LESS expensive.

13. WELLNESS RESERVES THE RIGHT TO AMEND, CANCEL OR WITHDRAW THE TERMS OF THIS REWARD SCHEME AT ANY TIME. WHEREVER POSSIBLE, WELLNESS WILL PROVIDE MEMBERS WITH ADVANCE NOTICE OF ANY SUCH CHANGES. MEMBERS WILL BE DEEMED TO HAVE ACCEPTED THESE TERMS AND ANY CHANGES TO THEM BY YOUR USE OF THE WELLNESS CARD OR REDEEMPTION OF REWARD GIFTS. THE WELLNESS CARD WILL AT ALL TIMES REMAIN THE PROPERTY OF WELLNESS.

14. WHERE MEMBERS REQUIRE A REFUND ON THE VALUE OF ALL OR PART OF A QUALIFYING PURCHASE, THE WELLNESS CARD OR DETAILS THEREOF MUST BE PRESENTED. THIS APPLIES TO ALL PURCHASES WHETHER IN STORE, ONLINE OR TELEPHONIC. THE REFUNDED AMOUNT WILL BE DEDUCTED FROM THE YEAR TO DATE SALES BALANCE. IF A REWARD GIFT HAS BEEN ISSUED TO YOU BEFORE A REFUND OR DEDUCTION THIS WILL RESULT IN A NEGATIVE SALES BALANCE. IN THIS CASE YOU WILL NOT BE ABLE TO REDEEM THE SAME REWARD GIFT WHEN REACHING THE REWARD POINT VALUE AGAIN.

15. REWARD BALANCES CANNOT BE TRANSFERRED FROM ONE REWARD SCHEME MEMBER TO ANOTHER. A WELLNESS CARD IS NOT TRANSFERABLE AND CAN ONLY BE USED BY THE PERSON NAMED ON THE CARD. REWARD SALES BALANCES CANNOT BE TRANSFERRED TO GIFT CARDS OR REDEEMED FOR CASH. REWARD SALES HAVE NO MONOTARY VALUE.

16. REWARD SCHEME MEMBERS MAY APPOINT AN ADDITIONAL CARDHOLDER (“ADDITIONAL CARDHOLDER”) BY VISITING THE INFORMATION DESK IN ANY OF OUR WELLNESS WAREHOUSE STORES (THIS EXCLUDES WELLNESS SELECT STORES). THE ADDITIONAL CARDHOLDER WILL BE ISSUED WITH THEIR OWN WELLNESS CARD WHICH WILL BEAR THE SAME MEMBERSHIP NUMBER AS THE REWARD SCHEME MEMBER. ADDITIONAL CARDHOLDERS WILL BE DEEMED TO HAVE ACCEPTED THESE TERMS IF THEY BEGIN TO USE THEIR WELLNESS CARD TO PARTICIPATE IN THE REWARD SCHEME. TRANSACTIONS MADE BY ANY ADDITIONAL CARDHOLDERS ON THEIR WELLNESS CARD WILL CONTRIBUTE TO THE REWARD BALANCE OF THE PRIMARY REWARD SCHEME MEMBER.

17. A MEMBERS WELLNESS CARD MAY BE CANCELLED FOR REASONS SUCH AS FRAUD OR A BREACH OF THESE TERMS. IF THIS OCCURS THE POINT BALANCE WILL ALSO BE CANCELLED AND NO REWARD GIFTS WILL BE ISSUED IN RESPECT OF SUCH SALES BALANCE.

18. IT IS THE MEMBERS RESPONSIBILITY TO NOTIFY WELLNESS OF ANY CHANGE OF CONTACT DETAILS. WELLNESS WILL NOT BE RESPONSIBLE FOR LOST, DELAYED OR UNDELIVERABLE EMAIL.

19. WELLNESS MAY REFUSE TO AUTHORISE THE ISSUE OF REWARD GIFTS IF WELLNESS REASONABLY CONSIDERS THE SCHEME IS BEING USED FRAUDULENTLY BY THE REWARD SCHEME MEMBER OR ANY ADDITIONAL CARDHOLDER.

20. IF THERE IS A QUERY RELATING TO THE SALES BALANCE, THE REWARD SCHEME MEMBER WILL BE RESPONSIBLE FOR PRODUCING (ON REQUEST) ANY REQUIRED PROOF OF PURCHASE FOR ANY TRANSACTION WHICH HAS BEEN ACCREDITED TOWARDS THE SALES BALANCE.

 

21. WELLNESS IS THE SOLE ADMINISTRATOR RESPONSIBLE FOR KEEPING MEMBERS PERSONAL DATA. WELLNESS AND THE PARTNERS WITHIN ITS GROUP RESERVES THE RIGHT TO USE THE INFORMATION SUPPLIED ON THE REWARD SCHEME APPLICATION FORM TOGETHER WITH INFORMATION RELATING TO YOUR TRANSACTIONS, PURCHASES AND PARTICIPATION IN THE REWARD SCHEME FOR THE PURPOSES OF ADMINISTERING THE REWARD SCHEME AND STATISTICAL ANALYSIS. DETAILS WILL ALSO BE USED FOR MARKETING PURPOSES, FOR NEWS ON SPECIAL EVENTS, OFFERS, PROMOTIONS AND CATALOGUES. IF RELEVANT PERMISSION HAS BEEN GIVEN ON YOUR APPLICATION FORM OR ELSEWHERE, DETAILS WILL BE PROVIDED TO OTHER CAREFULLY SELECTED COMPANIES WHO MAY HAVE OFFERS AND PROMOTIONS OF INTEREST TO YOU. IF AT ANY TIME YOU NO LONGER WISH TO RECEIVE SUCH INFORMATION OR YOU WISH TO CHANGE YOUR PREFERENCES, PLEASE WRITE TO:
